MEMBERSHIP REQUIREMENTS — You must be at least 18 years of age and agree to the terms and conditions of this agreement. Your SOUTH YUBA CLUB membership is for you alone; it cannot be transferred or sold. It may be terminated or suspended for violation of Club rules.
MEMBERSHIP FEES — There is a joining fee due at the time you sign up. Dues may be paid monthly or annually. Monthly dues are payable in advance each month and annual dues are paid one year in advance. If you cancel your membership or you let your membership lapse, you will need to pay a new joining fee. Except as provided in paragraph 4, the joining fee is non-refundable. Your monthly dues depend on the membership plan you select. We require electronic funds transfer (bank account or credit card) for payment of monthly dues. All charges are billed each month on the billing date you choose when you join. If your account becomes past due for any reason, you will be charged a late fee and your membership will be suspended until your account is current. Accounts over 45 days past due will be terminated and referred to a collection agency. There is a $25 service fee on overdue balances and for unsuccessful attempts to debit bank accounts or charge credit card accounts. Our dues and fees may change from time to time as well as certain services and classes. We will do our best to notify you in advance of any such changes.
FREEZE — Freezes may be taken for a minimum of 1 month, and must be taken in month long increments (from billing date to billing date). Monthly memberships are charged $10 per month during the freeze period. Annual paid in full membership terms are extended based on the length of the freeze period. Requests must be made in writing, received at least 5 days prior to your membership billing date, to take effect the following month and cannot be retroactive. Regular dues automatically resume on your billing date the month of which your freeze expires; you will not be notified.
DURATION OF MEMBERSHIP/CANCELLATION/BUYOUT/REFUNDS —
MEMBERSHIP CARDS — This is your passport to SOUTH YUBA CLUB. Try not to lose it. If you do, there will a $8 replacement charge. Only you can use your membership card. If you lend your card to others, we will cancel or suspend your membership.
RESERVATIONS — Some of our services (i.e., certain classes, programs, trainings, etc.) are available by advance reservation only. Please cancel at least 24 hours in advance or you will still have to pay the full charge. A no show fee maybe charged for lap swim and court reservations that are not cancelled prior to reservation.
SESSION/LESSON PACKAGES — Training Packages are billed on a recurring basis and will be auto-billed after the last session is used. Unused sessions do not expire for 12 months. Training packages may be cancelled at any time by simply completing the online cancellation form on the club’s website. Credit or refunds for unused session(s) may be given minus a $50 commission fee. Swim Lesson Packages do not expire for 12 months. Credit or refunds for unused session(s) may be given. Cancellations require at least 24 hours advance notice to avoid being charged for the session/lesson.
CHANGES IN FEES, RULES, SERVICES AND EQUIPMENT — From time to time, our fees, rules, services and equipment, including our membership rates, may change. We will try to post notice of these changes before they become effective or as soon as is practical. All dues and fees remain due and payable regardless of any changes.
GUESTS — SOUTH YUBA CLUB is a private Club. Non-members are not allowed to use the Club unless they are guests of SOUTH YUBA CLUB members and/or have purchased a pass. Guests must sign liability waivers before using the Club.
REJOINING — Should you terminate your membership or allow it to lapse, you may rejoin SOUTH YUBA CLUB by repaying the join fee.
DOCTOR’S APPROVAL AND RISK OF INJURY — As you know, exercise is beneficial, but there is a risk of injury, even death, associated with exercise, workout activities and the use of workout equipment. You need to understand that you are assuming all risks by joining SOUTH YUBA CLUB. Accordingly, you should consult with your physician before undertaking any workout program or activity. By joining SOUTH YUBA CLUB, you represent that you are in physically sound condition. If we question your condition to perform certain activities, we may require you to obtain medical certification before allowing you to work out here or on particular equipment.
WAIVER OF LIABILITY — We have a detailed waiver of liability agreement (Assumption of Risk and Release) for your review and agreement. You need to agree to the conditions of your membership and sign the waiver.
RULES/POLICIES — We have simple, common sense rules to ensure that you and other members have a good time. Check in when you arrive. Treat other SOUTH YUBA CLUB members with respect regardless of their age, sex, race, color, religion, sexual orientation or abilities. SOUTH YUBA CLUB is not responsible for personal items left, lost or stolen at the Club. Please let us know if you have any questions.
REGULAR HOURS OF OPERATION — Monday—Friday 4:30am-9pm. Saturday & Sunday 7am—7pm. Holiday Closures: Easter Sunday, Independence Day, Thanksgiving, Christmas. Limited hours: New Year’s Eve, New Year’s Day, Memorial Day, Labor Day, Christmas Eve, and December 26. There may be periodic closures for cleaning, maintenance, special events and due to severe weather conditions.
MORE STUFF TO READ — You acknowledge that your membership allows you to use the facilities and services but does not give you any ownership interest in any property or assets or any right to manage SOUTH YUBA CLUB. You also acknowledge that you have received a copy of this agreement, the waiver of liability agreement (Assumption of Risk and Release) and SOUTH YUBA CLUB General Etiquette Policies. If any part of this agreement is determined to be invalid, it shall not affect any other part. This agreement, together with its attachments, is the final and complete expression of your agreement with SOUTH YUBA CLUB. In joining the Club, you are not relying on anything not set out in this agreement. You accept the terms and conditions of this agreement.
